When Personal Injury Claims Get Complicated

Insurance companies do not always accept a claim just because someone was hurt. They may argue that:

  • the accident was minor
  • your injury was preexisting
  • you waited too long to get treatment
  • you were partly at fault
  • the property owner did not know about the hazard
  • your pain is not related to the accident
  • the available insurance is limited

These issues do not always defeat a claim, but they do need to be handled carefully. We look at the evidence, medical records, insurance coverage, and how the injury has affected your life so we can give you a clearer picture of the case.

  • another person or company may have caused your injury
  • your injury required medical treatment or caused you to miss work
  • your symptoms are getting worse rather than better
  • fault for what happened is being disputed
  • an insurance company is questioning your injuries
  • you are being asked to give a recorded statement
  • you received a settlement offer before you understand the long-term effects of the injury
  • you suffered a serious or permanent injury
  • there may be multiple responsible parties or insurance policies
  • you are unsure whether you actually have a claim

A free consultation can help you understand whether you may have a claim and what steps to take next.

Our Approach to Personal Injury Cases

Personal injury claims often turn on details: how the injury happened, what the medical records show, whether fault is disputed, what insurance coverage is available, and how the injury has affected your work and daily life. We work directly with clients to understand those details, gather the necessary evidence, identify potential problems early, and explain the realistic options for moving the claim forward.

What Can a Personal Injury Claim Pay For?

A personal injury claim may include compensation for:

  • medical bills
  • lost wages
  • pain and suffering
  • future medical care
  • permanent limitations
  • out-of-pocket expenses
  • the impact the injury has had on your daily life

The value of a claim depends on the facts. The injury, treatment, insurance coverage, fault, medical history, and long-term effects can all matter.

Frequently Asked Questions

How do I know if I have a personal injury case?
A personal injury claim may exist when another person, business, or property owner caused your injury through negligence or unsafe conduct. Important factors include how the injury happened, who was responsible, the available evidence, your medical treatment, and the effect the injury has had on your life. If you are unsure whether your situation qualifies, a consultation can help clarify your options.
How much does a personal injury lawyer cost?
We handle personal injury cases on a contingency-fee basis. That means you do not pay attorney fees upfront. Our fee is paid from the recovery if we obtain compensation for you. If there is no recovery, you do not owe an attorney fee.
How much is my personal injury case worth?
There is no standard settlement amount. The value of a claim depends on factors such as the severity of your injuries, medical expenses, lost income, future treatment, permanent limitations, pain and suffering, available insurance coverage, and whether fault is disputed. We evaluate these factors together rather than relying on a simple formula.
What if I was partly at fault for the accident?
You may still be able to recover compensation. Delaware and Pennsylvania generally allow an injured person to recover when they are no more than 50% responsible for what happened. Any compensation may be reduced according to the percentage of fault assigned to you.
Because fault is often disputed after an accident, it is worth getting legal advice before assuming that partial responsibility prevents you from having a case.
What if I had a preexisting injury or medical condition?
A preexisting condition does not automatically prevent you from bringing a personal injury claim. The important question is whether the accident caused a new injury or made an existing condition worse.

Insurance companies may try to argue that your symptoms existed before the accident, so medical records and evidence showing how your condition changed can become particularly important.
How long do I have to file a personal injury claim?
Deadlines depend on the type of case and where the injury occurred. For many personal injury cases in Delaware and Pennsylvania, a lawsuit generally must be filed within two years of the injury.

There can be exceptions and additional deadlines depending on the circumstances, so it is better to have a potential claim evaluated early rather than waiting until the deadline approaches.
Will my personal injury case have to go to court?
Not necessarily. Many personal injury claims are resolved through negotiation with an insurance company without going to trial. If the insurer disputes responsibility, undervalues the injuries, or refuses to make a reasonable offer, filing a lawsuit may become necessary.

We can explain the likely path of your case and what to expect at each stage.
What compensation can I recover after a personal injury?
Depending on the circumstances, compensation may include:

  • Medical bills and related expenses
  • Lost wages and lost earning capacity
  • Future medical treatment
  • Pain and suffering
  • Permanent injury or limitations
  • Out-of-pocket expenses
  • The effect the injury has had on your daily life
The available compensation depends on the facts of the case, the extent of the injuries, and the insurance or other sources of recovery available.
